This article, by attorney Joshua Pex, will explain situations under which a person may resign from his job and still be eligible for severance pay under Israeli law.<\/p>\n<p dir=\"ltr\"><strong>When would an employee who resigns receive severance pay?<\/strong><\/p>\n<h4 dir=\"ltr\"><strong>When it is contractually required<\/strong><\/h4>\n<p dir=\"ltr\"><img decoding=\"async\" class=\"wp-image-1842 size-medium aligncenter\" src=\"https:\/\/script_transfer_new.mowfns.ap-southeast-2.wpstaqhosting.com\/wp-content\/uploads\/2015\/11\/hands-business-300x199.jpg\" alt=\"resignation severance pay\" width=\"300\" height=\"199\" srcset=\"https:\/\/script_transfer_new.mowfns.ap-southeast-2.wpstaqhosting.com\/wp-content\/uploads\/2015\/11\/hands-business-300x199.jpg 300w, https:\/\/script_transfer_new.mowfns.ap-southeast-2.wpstaqhosting.com\/wp-content\/uploads\/2015\/11\/hands-business-1024x680.jpg 1024w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/>The most common reason is, of course, that it is part of the employee\u2019s employment contract. In the event that an employee is a member of a collective bargaining agreement, or if the employee has signed an <a href=\"https:\/\/script_transfer_new.mowfns.ap-southeast-2.wpstaqhosting.com\/en\/pensions-severance-pay-israel\/\" target=\"_blank\" rel=\"noopener\"><strong>Article 14 contract<\/strong><\/a> under the Severance Pay Law, so that the employer has put aside severance pay in advance, the employee will receive that severance pay even if he leaves his employment voluntarily. In this case, it does not matter how long he has worked or the reason for his termination of employment. In any event, he will receive severance pay based on his term of employment.<\/p>\n<h4 dir=\"ltr\"><strong>Under Israeli Labor Law, an employee who resigns is eligible for severance pay under the following conditions:<\/strong><\/h4>\n<p dir=\"ltr\">There are a number of situations, according to Israeli Labor Law, where an employee may receive partial or full severance pay on resignation, even with an ordinary employment contract. The list is lengthy and complicated, but here are some of the more common possibilities:<\/p>\n<ul dir=\"ltr\">\n<li>Reaching retirement age<\/li>\n<li>Illness of the employee or a family member for whom he provides care<\/li>\n<li>Becoming a parent, biological or other (if the employee resigns within nine months of the child\u2019s arrival)<\/li>\n<li><a href=\"https:\/\/script_transfer_new.mowfns.ap-southeast-2.wpstaqhosting.com\/en\/deteriorating-work-conditions-severance-pay-upon-resignation\/\" target=\"_blank\" rel=\"noopener\">Worsening work conditions<\/a> (if the employer was warned and given a chance to improve said conditions before resignation)<\/li>\n<li>Being called up to service (army, national service)<\/li>\n<li>Closing of the place of employment<\/li>\n<li>Relocation of employee&#8217;s residence, but only for specific reasons (marriage, divorce and <a href=\"https:\/\/www.nevo.co.il\/law_html\/Law01\/p189_001.htm#Seif8\" target=\"_blank\" rel=\"noopener\">other circumstances delineated by law)<\/a>.<\/li>\n<\/ul>\n<p dir=\"ltr\">In general, Israeli law tries to be supportive of employees who are forced to leave their place of employment involuntarily.
